Request for Review of Procedural Concerns Affecting Access to Appellate Review – Marin County Family Court Matter Nick Garcia

Dear San Mateo County Legislators and Oversight Officials,
I hope you are doing well
I am writing respectfully in your administrative, legislative, and oversight capacities to document ongoing procedural concerns arising from Marin County Superior Court Case No. FL2103195 and the related appeal currently pending before the California First District Court of Appeal (Case No. A175838).
I am a self-represented litigant and father involved in a family law matter affecting parental rights and appellate access. My purpose in writing is not to seek intervention in any pending judicial decision, but rather to preserve and document concerns involving court administration, procedural transparency, and meaningful access to appellate review.
Attached are copies of recent filings and correspondence concerning the following issues:
• Filed and stamped documents that currently do not appear on the Marin County Superior Court docket despite being filed and served;
• An unresolved Request for Hearing on Court Fee Waiver Order (FW-006);
• A default notice relating to reporter’s transcript fees despite the absence of any known transcript cost estimate, invoice, billing notice, payment directive, or payment deadline;
• Written confirmation from the Court of Appeal indicating that the appellate court itself is awaiting clarification from the superior court regarding the status of the record and alleged default notice.
Last week, after personally contacting the Marin County clerk’s office to inquire about the alleged transcript bill, I was informed that staff could not locate any record of such billing and advised me to submit my inquiry in writing.
As a self-represented litigant, I have made every effort to comply fully with all procedural requirements and to preserve a clear and accurate record. My concern is not limited to my individual case, but extends more broadly to questions of procedural consistency, docket accuracy, and meaningful access to appellate review for ordinary Californians navigating the court system without counsel.
I recognize and respect the independence of the judiciary and am not requesting intervention into any judicial ruling or outcome. I am simply requesting awareness and preservation of these concerns as matters potentially affecting public confidence, transparency, and access to justice.
