Dear Council Members, Complete Streets Commissioners, and Staff,
At recent meetings of the City Council and Complete Streets
Commission, there has been discussion of the "85th Percentile Rule",
the state law that requires jurisdictions to set speed limits no lower
than the speed that 85% of drivers are measured to travel, and
prohibiting enforcement of lower speed limits.
Safety advocates around the US have long raised concerns about the
impact of this policy on safety.

The Metropolitan Transportation Commission has recently published
their draft legislative agenda for 2021, which includes an item
recommended by the region's Zero Traffic Fatalities Task Force to
pursue legislation in Sacramento to modify the 85th percentile
methodology. See quote below and attached document.
In the interest of local flexibility, vision zero policy and safety,
the City Council will have the opportunity to support the regional
legislative platform item and potential state legislation.
A. Zero traffic fatalities goal (Vision Zero)
Building on the recommendations of the Zero Traffic Fatalities Task
Force, support legislation aimed at achieving the Vision Zero goals of
no roadway related deaths or serious injuries by improving safety for
all road users, including non-motorists. In particular, support
modifying the state’s 85th percentile methodology for determining
speed limits to provide greater flexibility to local agencies and
continue to support authorization of automated speed enforcement
technology to enforce speed limits.
For our consideration,
- Adina
