Dear Members of the City Council, I hope you will give all possible consideration to preserving Menlo Park's beautiful heritage redwood trees. This evening my husband and I witnessed a number of birds flying in and out of the trees. So, if regretfully, you decide not to save the trees you must at least postpone their removal. It is nesting season, and the federal Migratory Treaty Act of 1918 (MBTA) requires that these trees not be disturbed during nesting season. The definition of "migratory" includes 99.9% of all America's birds. One example of "migratory" can be defined as flying from one tree to the next. "The statute makes it unlawful without a waiver to pursue, hunt, take, capture, kill, or sell birds listed therein as migratory birds https://en.wikipedia.org/wiki/Bird_migration >. The statute does not discriminate between live or dead birds and also grants full protection to any bird parts including feathers, eggs, and nests. Over 800 species are currently on the list."
