Re: Filing a complaint about violation of setback law

To our Elected Officials,

We are writing again on clear setback volition of our neighbor’s new ADU construction that the City building division permitted.

We demand our elected officials to investigate and reverse this permitting mistake. They are in clear violation of the City’s setback rules based on two independent survey. The planning division (Chuck Andrews and the team) issued this permit to our neighbor out of negligence and they are not incentivized to revert their mistake nor do they respond to our repeated request.

We would like the City Council to initiate an independent investigation into this matter. As tax-paying law-abiding citizens, we demand the City to enforce the building codes. We will fight it all the way to make sure the finals are not issued to this neighbor. We should not allow incompetence and negligence of building division create disarray in the City.


Here is the original case we have brought to your attentions on March 31, 2022.




We are the owner of “2143 Menalto Avenue”. We have the proof that our neighbor at “104 Haight” has built an ADU that is in violation of the City setback law. We hired Underwood & Rosenblum, Inc. to perform a survey on our home property lines and 104 Haight’s ADU. Attached please find:

- Photo of 104 Haight’s ADU marked in letter B. Our home “2143 Menalto” is marked in letter A.
