For the record: Your MP process is not following SB9 process as far as requiring a final parcel map and signed 3 year affidavit with the SB9 application when that creates a clear issue since we do not know at this stage who will leave into one of the lots that is the reason SB9 steps are to initially submit a tentative map review/approval followed by a 12 months window to file for the final map at which stage applicant can determine who will live for 3 years in one of the house/lots. Your process forces the applicant to have a signed affidavit at this early stage, just for the city to review the application, which is not the intent of SB9. None of the experienced L&Braze civil engineering consultants who are working on other SB9s for other cities have seen this demand/path, including me, who completed 1st SB9 in Atherton 2 years ago. The applicant wants this to be on record that the city of MP cannot make its own rules on SB9 application processing/steps and we do not believe that your SB9 process complies with the intent of the SB9 state law. We also will reserve the right to swap our submitted signed affidavit before the final map is signed off by the city.
